Solas obligations and the case of MV Moscow University

International law imposes certain obligations on ships at sea, including obligations regarding the treatment of detainees. The International Convention for the Safety of Life at Sea 1974 (SOLAS), and the United Nations Convention on the Law of the Sea 1982 (LOSC), oblige vessels to come to the rescue of seafarers in distress.' SOLAS makes an exception for naval vessels used only on government non commercial service, but those, too, are urged to comply.2 The International Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation (SUA) requires that persons taken into custody be guaranteed fair treatment in conformity with 'applicable provisions of international law, including international human rights law'.3 Further, SOLAS requires that persons, such as suspected pirates, who are detained and then released for whatever reason be returned to seaworthy vessels and/or safe conditions.4 While the full evidence is not publicly available, it would appear that actions taken by the Russian destroyer BPK Marshal Shaposhnikov after its rescue of the hijacked tanker MV Moscow University may constitute a serious violation of these obligations.
